Unfortunately, there aren’t any rules specifically making bank collections calls illegal on holidays, but there are rules that prohibit debt collectors from contacting consumers at odd or inconvenient times.

    Can debt collectors call on public holidays?

    While there are technically no specific prohibitions on debt collection agencies calling on holidays, this may fall into a category that is not allowed under the Fair Debt Collection Practices Act (FDCPA). According to the FDCPA, a debt collection agency must not communicate with a consumer “at an unusual time or place, or at a time or place known or known to be inconvenient to the consumer”.

    Since many holidays are public knowledge, you can usually expect collection agencies not to call during these times. It is important to note, however, that not all cities, states, or countries recognize the same holidays. On “major holidays” like Christmas Eve and New Years, debt collectors are less likely to attend “minor holidays” like Ash Wednesday or Rosh Hashanah.

    There are no specifics in the FDCPA that prevent a debt collector from calling on Sundays. It isn’t necessarily an unusual day or a known inconvenience. If you want to prevent debt collectors from calling you on Sundays or Shabbat, you must tell them this is an awkward time for you.

    What times can a debt collection agency call?

    According to the FDCPA, debt collection companies can only call between 8 a.m. and 9 p.m. These times are also based on your local time and not on the location of the debt collection company.

    How many times a day can a debt collection agency call?

    The Fair Debt Collection Practices Act does not stipulate how often a debt collection agency can call each day. However, it does state that a collection company cannot call repeatedly or constantly to harass you.

    Can a debt collection agency contact you on social media?

    Debt collection agencies can contact you on social media. However, they are only allowed to send you a message directly on a platform and not post comments or post messages where others can see them.

You no longer need to phone creditors after filing your application, but that doesn’t mean you don’t still owe the debt. They can still take other actions to collect them and they can reach out to you to let you know that they will take legal action.

    What if you ignore collection agencies?

    You may think of ignoring calls from debt collection agencies, but worry about the consequences. In some cases, if you ignore these calls, nothing will happen. The creditor might stop coming back.

    But that’s not always the case. Ignoring these calls could result in negative consequences.

    If you are to blame and you continue to ignore collections, you could face a wage garnishment or lawsuit. Your creditworthiness and credit report can also take a hit. However, you shouldn’t have to take calls at inappropriate times or on holidays. When you have a debt, it is a good idea to work with the debt collection agency and think about ways to settle it in order to avoid other negative consequences.

    How can you keep debtors from disrupting the holidays?

    If you’re getting calls from billing collectors and you’re worried they might call on a holiday, here are some things to do:

    Ask them to stop

    Consumers have rights that are set out in the FDCPA. One of them is eliminating the need for a debt collection company to contact you after you send a letter asking you to do so. You will still be liable for any debts you owe, but you will have to honor your request and no longer reach each other over the phone.

    This must be done in writing – not by telephone. Consider keeping a copy of the letter you sent for your records. You can also send the letter by registered mail so that you know when the debt collector received it.

    Work out a payment plan

    If you want to ease your financial stress and don’t want the collector to take any further action, you should negotiate a repayment plan with your creditor. If you do this, make sure that everything is written down.

    If the claim has not yet been collected, the creditor may be willing to work with you. In some cases, creditors can waive fees, lower the total amount due, or lower the interest rate if that means they can collect some of the debt from you.

    Note: While completing a repayment schedule can stop calls for collections, it might not have a positive impact on your creditworthiness until the collection agent marks the claim as current or paid.
